1. Nature of the platform
Nexvend operates a curated marketplace intermediary platform that connects independent third-party vendors with buyers in Kuwait. Nexvend is not the seller of items listed on the platform, does not take ownership of marketplace inventory, and is not a licensed escrow provider. Nexvend does not guarantee the authenticity of any item unless it is explicitly marked as "Nexvend Verified".
2. Vendor responsibility
Vendors are solely responsible for: the legality, accuracy, and quality of their listings; possessing the right to sell each item; fulfilling orders accurately and on time; and complying with all applicable Kuwaiti commercial, customs, and consumer-protection laws. Vendors agree to honour the price, condition, and description shown on each accepted order.
3. Prohibited items
The following may not be listed: weapons or ammunition, illegal substances, counterfeit goods, items infringing third-party intellectual property, prescription medication, regulated alcohol or tobacco, currency or financial instruments, live animals, and any item prohibited under Kuwaiti law. Nexvend may remove listings and suspend accounts at its sole discretion.
4. Payments
Payments are processed through licensed third-party payment providers (currently MyFatoorah). Funds for confirmed orders are held until delivery is confirmed, after which payouts are released to the vendor. All amounts are denominated in Kuwaiti Dinar (KWD) unless otherwise displayed.
5. Delivery
Delivery is coordinated through approved logistics partners (currently TryRiders). Tracking updates are surfaced through the platform. Delivery timelines are estimates; Nexvend is not liable for carrier delays.
6. Offers and acceptance
Buyers may submit binding offers on listings that allow them. An accepted offer creates an order; the buyer must complete payment within the displayed window or the order is cancelled. Vendors must respond to offers within their displayed validity period.
7. Reviews and content
Reviews must reflect genuine buyer experience. Nexvend may moderate, hide, or remove content that is defamatory, inaccurate, or that violates these terms.
8. Moderation and suspension
Nexvend reserves the right, at its sole discretion, to remove listings, cancel orders, withhold payouts pending investigation, and suspend or terminate accounts for breach of these terms or applicable law.
9. Disputes
Disputes must first be raised through in-platform support. Unresolved disputes are governed by the laws of the State of Kuwait and subject to the exclusive jurisdiction of Kuwaiti courts.
10. Liability
Nexvend's liability for any single transaction is limited to the value of that transaction. Nexvend does not warrant uninterrupted availability of the platform.
